Confidentiality agreement

I hereby request further details and documentation regarding the business you have on offer. I am obliged to treat any information to do with these business matters with the strictest confidentiality and only use it for my own purposes, and also to refrain from any communication of this business to a third party. (§3 Abs2 MaklerG).

If a business agreement is reached, I am obliged to pay you the industry standard agency commission of 3% of the net purchase price plus 20% VAT. The right to commission is also applicable if the estate agent has generated the income not by providing evidence of a business opportunity or naming the interested party, but as a result of negotiations that he has handled, which have led to a completed deal. Furthermore, the obligation to pay commission applies in the event that the actual legal transaction is brought about together with another person or persons (business partners) who was/were informed of the business opportunity by the signed client.

The payment of the commission, calculated according to the amount of the purchase price, is 3% plus 20% VAT or with rentals, calculated according to the rental price, is 3 months rental plus 20% VAT, is also applicable:

  • If, due to the agencies activities, the transaction to be brought about pursuant to the contract is not entered into, but another transaction is entered into, the economic purpose of which is equivalent to the original transaction.
  • Should the business form of the owners object be changed whilst in the contract phase.

The conditions of business outlined above also apply to any other business matters made known to the contractor subsequently by the estate agent.
